These Terms and Conditions (“Terms”) govern your access to and use of the Hoast Events mobile application, website, and related services (collectively, the “Services”) operated by Hoast Events Corporation (“Hoast,” “Hoast Events,” “we,” “us,” or “our”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

By creating an account or using the Services, you represent that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

Description of Services

Hoast Events provides a digital marketplace that connects customers with event service providers (“Vendors”), including but not limited to DJs, caterers, and other event professionals. The Services allow Vendors to promote their services and allow customers to discover, communicate with, book, and pay Vendors.

Hoast Events is not a provider of event services and does not directly perform or control any Vendor services.

III. Eligibility

You must be at least 18 years old to use the Services. By using the Services, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

User Accounts

To access certain features, you must create an account.

You agree to:

Provide accurate and complete information;
Maintain the confidentiality of your login credentials;
Promptly update your account information as needed; and
Be responsible for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that contain false information or violate these Terms.

Vendor Terms

If you register as a Vendor, you agree to:

Provide accurate, current, and complete business and service information;
Honor bookings and agreements made through the platform;
Deliver services in a professional and lawful manner;
Comply with all applicable laws, licenses, and regulations;
Maintain appropriate insurance, certifications, or permits as required.

Vendors are solely responsible for the services they offer and perform. Hoast Events does not guarantee the quality, safety, legality, or delivery of Vendor services.

Customer Terms

If you use the Services as a customer, you agree to:

Provide accurate event and booking information;
Communicate honestly with Vendors;
Pay for services as agreed;
Review Vendor terms, pricing, and policies before booking.

Customers are responsible for evaluating Vendors and entering into agreements at their own discretion.

VII. Payments and Transactions

The Services may allow payments to be processed within the platform through third-party payment providers.

By making or receiving payments through the Services, you agree that:

Transactions are processed by third-party payment processors;
Hoast Events is not a bank, financial institution, or payment processor;
We may facilitate payment processing but do not hold funds as a financial institution;
Fees, taxes, and transaction costs may apply;
You are responsible for providing accurate payment and payout information.

We may implement measures to prevent fraud, including transaction monitoring and account restrictions.

VIII. Cancellations, Refunds, and Disputes

Cancellations, refunds, and disputes may be subject to:

Vendor-specific cancellation policies;
Platform policies established by Hoast Events; and
Third-party payment processor rules.

Hoast Events may, but is not obligated to, assist in resolving disputes between users. Final responsibility for agreements rests with the customer and Vendor.

Platform Role and Disclaimer

Hoast Events acts solely as a marketplace platform.

We do not:

Employ or control Vendors;
Guarantee the quality, safety, or legality of services;
Guarantee that bookings will be fulfilled;
Act as an agent for either customers or Vendors.

Any agreements formed are solely between users.

User Content

You may submit content, including profiles, reviews, images, messages, and other materials (“User Content”).

By submitting User Content, you grant Hoast Events a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute such content in connection with the Services.

You represent that:

You own or have rights to the content; and
The content does not violate any law or third-party rights.

We reserve the right to remove content that violates these Terms.

Prohibited Conduct

You agree not to:

Use the Services for illegal or fraudulent purposes;
Misrepresent your identity or services;
Circumvent payment systems;
Interfere with platform functionality or security;
Upload harmful, abusive, or infringing content;
Attempt unauthorized access to accounts or systems.

XII. Intellectual Property

All content, features, functionality, trademarks, logos, and software associated with Hoast Events are owned by Hoast Events Corporation or its licensors and are protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, or create derivative works without prior written consent.

We may suspend or terminate your account at our discretion, including if you:

Violate these Terms;
Engage in fraudulent or harmful conduct;
Pose a risk to the platform or its users.

You may stop using the Services at any time.

XIV. Disclaimers

The Services are provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, Hoast Events disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee:

Continuous or error-free operation;
Accuracy of listings or content;
Performance or reliability of Vendors.

Limitation of Liability

To the maximum extent permitted by law, Hoast Events shall not be liable for:

Indirect, incidental, special, or consequential damages;
Loss of profits, revenue, data, or business opportunities;
Damages arising from Vendor services or user interactions.

Our total liability for any claim shall not exceed the amount paid by you (if any) to Hoast Events in the twelve (12) months preceding the claim.

XVI. Indemnification

You agree to indemnify, defend, and hold harmless Hoast Events Corporation and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of:

Your use of the Services;
Your violation of these Terms;
Your interactions with other users;
Your User Content.

XVII. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles.

Any disputes arising from these Terms or the Services shall be resolved in the state or federal courts located in Georgia, unless otherwise required by law.

We may update these Terms from time to time. When we do, we will update the “Last Updated” date.

Your continued use of the Services after changes become effective constitutes your acceptance of the revised Terms.
